1. Acceptance of Terms

By accessing and using the Kunam AI Smile Design service ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Use constitute a legally binding agreement between you ("User" or "you") and Kunam AI Smile Design ("Company," "we," "us," or "our") regarding your use of our AI-powered smile design platform.

2. Service Description

Kunam AI Smile Design provides an artificial intelligence-powered platform that generates cosmetic smile design visualizations based on user-uploaded photographs. Our service is intended for:

• Cosmetic visualization and design planning purposes only
• Educational and consultation support for dental professionals
• Patient communication and treatment planning assistance
• Digital smile design mockups and previews

3. User Responsibilities and Acceptable Use

3.1 Account Registration

You must provide accurate, current, and complete information during registration and maintain the security of your account credentials. You are responsible for all activities that occur under your account.

3.2 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload images that are not your own or for which you lack proper consent
• Use the Service for any illegal, harmful, or fraudulent activities
• Attempt to reverse engineer, modify, or create derivative works of our AI technology
• Upload inappropriate, offensive, or copyrighted content
• Interfere with or disrupt the Service or servers
• Use the Service to provide medical advice or treatment recommendations
• Misrepresent AI-generated results as actual treatment outcomes

4. Intellectual Property Rights

4.1 Our Intellectual Property

The Service, including but not limited to its AI algorithms, software, design, text, graphics, and other content, is owned by Kunam AI Smile Design and is protected by copyright, trademark, and other intellectual property laws.

4.2 User Content

You retain ownership of the original photographs you upload. By using our Service, you grant us a limited, non-exclusive license to process your images for the purpose of providing the smile design service. Generated smile designs are considered derivative works created through our proprietary AI technology.

4.3 Usage Rights

You may use the generated smile designs for personal consultation and treatment planning purposes. Commercial use or redistribution of our AI technology or generated content requires separate written agreement.

5. Payment Terms and Refund Policy

5.1 Token-Based System

Our Service operates on a token-based payment system. Tokens are required to process smile design requests and are consumed upon successful generation of results.

5.2 Payment Processing

Payments are processed securely through our third-party payment processor (Omise). We do not store your payment information on our servers. All transactions are subject to the payment processor's terms and conditions.

5.3 Refund Policy

Refunds may be considered in the following circumstances:

• Technical failure preventing service delivery
• Duplicate charges due to system errors
• Service unavailability for extended periods

Refund requests must be submitted within 7 days of the transaction. Tokens used for successful smile design generation are non-refundable.

6. Data Processing and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the data practices described in our Privacy Policy.

We comply with applicable data protection laws, including the Thailand Personal Data Protection Act (PDPA), and implement appropriate security measures to protect your information.

7. Limitation of Liability and Disclaimers

7.1 Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

7.2 AI Technology Limitations

Our AI technology provides estimates and visualizations based on algorithmic processing. Results may vary and should not be considered as guaranteed outcomes or professional medical assessments.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUNAM AI SMILE DESIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

8. Account Termination

We reserve the right to terminate or suspend your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will cease immediately, and we may delete your account data in accordance with our data retention policies.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.
